Brockton truck had poor brakes

Brockton police say the tractor trailer that struck and killed a 12 year old boy had safety violations.

According to the Boston Herald, the trailer's brakes were in poor condition. The Massachusetts State Police cited the truck's owner, Spiegel South Shore Scrap Metal for two safety violations.

The police also told the paper the dump truck's horn did not work.

The accident Thursday killed Nazair Nunes-Escobar, who was rollerblading. The boy had received the inline skates that day for his birthday.

The Plymouth District Attorney's office says the accident remains under investigation.{} No charges have been brought against the driver.
