Police: Driver asked father if it was OK to back up before hitting child

Providence police said the father of a 15-month-old boy gave a neighbor the all clear before she backed out of a driveway and struck his son.

Police said Justin Diaz Cabral was taken to Hasbro Children's Hospital on Tuesday morning in critical condition. He underwent surgery but remains in critical condition.

Police were called to a home on Gillen Street at about 9:30 a.m.

According to police, the father had the boy out in the yard of their home. The father was talking with a couple of people.

Police said the neighbor, a 28-year-old woman, was preparing to back out of the driveway and asked the father if there was anyone behind her. According to police, the father said no and that it was clear.

Commander Thomas Oates of the Providence Police Department said Tuesday the woman didn't realize what had happened until the family called to let her know. The woman then rushed to the hospital to see the boy.

According to police, the woman met with investigators at the hospital.

Police had taken the woman into custody for questioning, but was released. Police said she's not facing charges.

The family said it doesn't blame the woman.
