A surgeon is reprimanded by Rhode Island health authorities for performing a surgery after he found out he tested positive for COVID-19 the night before.

The Board of Medical Licensure and Discipline found that Dr. Malcolm Kirk performed a surgery at Rhode Island Hospital in January while he was COVID-positive.

Kirk later admitted he conducted the surgery while COVID positive, according to the board’s order of reprimand.

Kirk will pay a $1,100 administrative fee to the state.

Lifespan said in a statement to NBC 10, “Dr. Malcolm Kirk is not employed by Lifespan and has only admitting privileges at Rhode Island Hospital. We conducted our own investigation earlier this year regarding the complaint, and consider the matter resolved.”

Kirk specializes in cardiovascular medicine.

NBC 10 News left a message at Kirk’s office seeking comment.
